Examining the Impact of China's "Anti-Secession" Law

A Look at the Legislation's Implications on Cross-Strait Relations and Taiwan's Sovereignty

As Beijing commemorated the 20th anniversary of its "Anti-Secession" Law, a reiteration of its non-binding nature was issued by Taiwan's Mainland Affairs Council (MAC).

The legislation, intended to deter and counter what Beijing perceives as separatist forces in Taiwan, has been a point of contention in cross-strait relations. The MAC emphasized that the law holds no legal authority over Taiwanese citizens or the sovereignty of the Republic of China.

China's objectives, as articulated by officials, center on maintaining dominance and initiative over cross-strait relations, with the ultimate aim of "unifying" the nation. The "Anti-Secession" Law is seen as a tool to achieve this, operating under the guidance of a specific ideological framework.

The law also aims to maintain national sovereignty and territorial integrity by utilizing countermeasures and deterrence, effectively drawing a "clear red line" concerning the potential use of force against pro-independence actions.

In response, the MAC stated that the law is part of Beijing's efforts to wage lawfare against Taiwan. Furthermore, they pointed out that such actions only serve to alienate the Taiwanese population, escalate mutual hostilities, and impede diplomatic progress across the Taiwan Strait.

The Council asserted its commitment to defending Taiwan's sovereignty, democracy, prosperity, peace, and stability, standing in solidarity with all Taiwanese in the face of Beijing's ambitions. The resilience of the Taiwanese people in resisting annexation was also highlighted.

Passed in 2005, the "Anti-Secession" Law provides a legal framework for China to address what it considers "secessionist" actions in Taiwan, including the potential use of "non-peaceful means."
